Dangerously Fit Shipping Protection Charter

1. Your Rights Under U.S. Consumer Law

Dangerously Fit is committed to complying with U.S. federal and state consumer protection laws, including the Federal Trade Commission (FTC) Act, Magnuson-Moss Warranty Act, and applicable state laws.

When you purchase from us, you are entitled to:

  • Products that match their description

  • Goods delivered within the timeframe stated (or within a reasonable time)

  • Products that are free from defects at the time of shipment

  • Transparent pricing and fees (no hidden charges)

Nothing in these Terms overrides rights provided by U.S. law.

2. What is “Shipping Protection”? (Optional Add-On Service)

Shipping Protection is an optional, premium service offered at checkout.
It does not replace the rights you already have under U.S. law, but provides additional benefits for courier-related issues such as loss or damage in transit.

Shipping Protection provides:

  • Faster support response times

  • Priority handling of your issue

  • Express replacement shipping (no additional cost)

  • Replacement dispatched before return, when applicable

  • Guaranteed resolution in cases of courier loss/damage

This service is optional and non-mandatory.

3. What Shipping Protection Covers

If Shipping Protection was purchased, you are eligible for:

  • Replacement or refund if a parcel is lost in transit

  • Replacement or refund if a parcel is damaged during transit

  • Replacement or refund if the order is mis-delivered or incorrectly marked “delivered”

  • Priority support + expedited handling

When possible, replacements are shipped before the original is returned, for faster resolution.

4. What Shipping Protection Does Not Cover

Shipping Protection does not apply in the following scenarios:

  • Customer enters an incorrect or incomplete shipping address

  • Customer requests an address change after dispatch

  • Parcels stolen after confirmed delivery (porch piracy)

  • Customer refuses delivery or fails to collect the package

  • Items damaged due to misuse, modification, or normal wear and tear

  • Delays, loss, or damage caused by:

    • Natural disasters

    • Severe weather

    • Customs (for cross-border shipments)

    • Carrier strikes

    • Other events outside the courier’s control

  • Orders shipped without Shipping Protection (Standard Delivery)

These exclusions follow standard U.S. carrier rules (UPS, FedEx, USPS).

5. How to File a Shipping Protection Claim

If you added Shipping Protection at checkout:

Subject line: “Shipping Protection Claim – Order #XXXXX”

Include:

  • Full name

  • Order number

  • Description of the issue (lost / damaged / not delivered)

  • If damaged: clear photos of packaging + product

Time limits:

  • Damaged deliveries → report within 3 days of tracking showing “delivered”

  • Missing deliveries → report within 3 days of estimated delivery date

We will process your claim as quickly as possible. If approved, we will either:

  • Ship a replacement immediately (Express), or

  • Issue a refund if the item is out of stock

6. If You Decline Shipping Protection (Standard Delivery)

Orders shipped without Shipping Protection are classified as Standard Delivery.

We will still assist you by opening a courier investigation, but:

  • Replacements are not guaranteed

  • Refunds are not guaranteed

  • Resolution times depend on the courier (UPS/FedEx/USPS), not us

  • Replacements cannot be shipped prior to courier confirmation

Standard delivery is subject to normal carrier liability limitations.

7. Shipping Protection Fee

Shipping Protection is charged at 1.5% of cart total.

This fee applies per order, not per item.

8. Returns & Warranty (U.S. Compliance)

Under the Magnuson–Moss Warranty Act, if a product is defective when you receive it, you are entitled to a remedy:

  • Replacement

  • Refund

  • Repair (where applicable)

This applies regardless of whether you purchased Shipping Protection.

Change-of-mind returns are not required by U.S. law and may be offered at our discretion.

9. Limitations of Liability

To the maximum extent permitted under U.S. law:

  • We are not liable for indirect, incidental, or consequential damages (including lost profits, lost time, loss of training ability, etc.)

  • Our maximum liability for any claim is limited to the purchase price of the affected product(s)

  • We are not responsible for delays caused by carriers, weather, disasters, or other external factors

These limitations do not apply where prohibited by state law.

10. Fraud Prevention & Abusive Claims

Dangerously Fit reserves the right to reject claims involving:

  • Fraudulent reports

  • Repeated claims with inconsistent evidence

  • Abuse of Shipping Protection or Standard Delivery policies

False claims may be referred to the carrier or relevant authorities.

11. Modifications to These Terms

We may update these Terms at any time.
Changes apply only to orders placed after the updated Terms go live.
